MADRID, Spain — The Criminal Chamber of the Spanish Supreme Court has sentenced former Transport Minister José Luis Ábalos to 24 years and three months in prison for his central role in a massive corruption network involving criminal organization, bribery, embezzlement, and influence peddling. The landmark ruling, handed down unanimously by the Second Chamber, also imposed an 19-year and eight-month sentence on his former advisor, Koldo García, for the same offenses committed during the so-called masks procurement scandal.
European Parliament Report Warns Of ‘Institutional Deterioration And Rising Corruption’ In Spain
Lobbyist Víctor de Aldama received a four-and-a-half-year prison sentence, though its execution has been suspended, meaning he will avoid immediate incarceration. The suspension is contingent upon Aldama not committing any crimes for a period of five years, appearing before the Supreme Court semi-annually to report his business activities, and completing one year of community service. The court established that the maximum effective prison terms for Ábalos and García will be 16 and a half years and 15 years, respectively, closely mirroring the penalties requested by the Anti-Corruption Prosecution. All three convicts were ordered to jointly forfeit 430,298 euros in illicit gains derived from bribery. Aldama’s significantly reduced sentence was granted due to his extensive and highly qualified collaboration with judicial authorities.

The court found it proven that Ábalos and García orchestrated the rigging of public contracts to award the supply of 13 million protective masks to Soluciones de Gestión, a company linked to Aldama. The tribunal detailed how the former minister used his influence to benefit the company in contracts managed by Puertos del Estado and Adif. In return, Aldama agreed to pay monthly bribes of 10,000 euros to both Ábalos and García between October 2019 and June 2022. Additionally, Aldama covered the 2,700-euro monthly rent for an apartment in Madrid’s Plaza de España belonging to Jésica Rodríguez, a woman linked to the former minister, and facilitated a lease-to-own agreement for a luxury apartment on Paseo de la Castellana for Ábalos himself. The court noted that Aldama channeled over 6.6 million euros in commissions through his companies, Deluxe Fortune and MTM 180 Capital SL.
Beyond the mask contracts, the ruling exposed a systematic abuse of power for personal and romantic gain. The tribunal confirmed that Ábalos and García illegally placed Rodríguez, with whom the former minister was having a romantic relationship, into public companies Ineco and Tragsatec. Similarly, they orchestrated the hiring of Claudia Montes at Logirail, a company within the Renfe group. The court traced the origins of this criminal network back to the internal campaigns of the Spanish Socialist Workers’ Party, where Ábalos first met García, who was trusted by party official Santos Cerdán. The trio later connected with Aldama in 2018, recognizing an opportunity for mutual financial enrichment that evolved into a persistent criminal enterprise.

The extensive ruling also detailed how Aldama financed luxury vacations for the former minister as a reward for political favors. Ábalos enjoyed a free stay at a villa in Marbella in August 2020 after issuing a ministerial statement to calm creditors of the airline Air Europa, at Aldama’s request. Furthermore, Aldama’s business partners purchased a chalet in Cádiz for Ábalos’s use following the former minister’s efforts to help a hydrocarbon company secure an operating license, though the court ruled that specific administrative favor did not constitute a crime. While the Supreme Court upheld the core charges of criminal organization, bribery, embezzlement, and influence peddling, it rejected the additional charges of insider trading proposed by the prosecution and prevarication raised by popular accusations.

In its comprehensive 200-page judgment, the Supreme Court emphasized that the most severe consequence of these crimes is the profound deterioration of citizen confidence in the political system. The tribunal noted that the actions of the former minister shattered the fundamental expectation that democratic power is exercised for the benefit of the entire populace. As the legal proceedings conclude at the highest judicial level, the focus now shifts to the execution of the sentences and the ongoing efforts to recover the defrauded public funds.
